opened for disembarkation after landing, if he has reasonable grounds to believe that any person on board an aircraft may jeopardise the safety of the aircraft or inflict damage on any other person or property therein or disturb the peace on board or behave in a disorderly manner on board, or is about to commit such acts, up to the necessary limit for the maintenance of safety of the aircraft, protection of any other person or property therein, or maintenance of peace and order on board, adopt measures to restrain such a person or adopt other necessary measures to suppress these acts, or disembark the offending person.

 

2. The pilot-in-command shall not, after landing and having restrained any person in accordance with the provisions of a preceding paragraph, except when such person agrees to onward carriage under restraint, or there exists mitigating circumstances against disembarking the offending person, take-off with such person on board under any form of consecutive restraint.

 

3. Any person on board the aircraft may, in accordance with the request or approval of a pilot-in-command, affect the necessary assistance to implement the remedial measures specified in paragraph 1.

 

4. The pilot-in-command shall, when he lands an aircraft, and if he has a person on board under restraint in accordance with paragraph 1, or if he has a person on board to disembark in accordance with the provisions of the same paragraph, notify the nearest air traffic control facility to that effect with the reason for restraint or disembarkation, as early as possible prior to landing.

 

(Measures in case of Danger)
Article 74. The pilot-in-command may in the event of a dangerous occurrence or when in his opinion danger is imminent, to the aircraft or passengers, order the passengers on board regarding the procedures for evacuation or other matters necessary for safety (excluding assistance necessary for the pilot-in-command to adopt measures specified in the preceding article paragraph 1.)

 

Article 75. The pilot-in-command shall, in the event of the occurrence of a dangerous incident to the aircraft during flight employ every possible means necessary for rescuing passengers and preventing injury or damage to persons or property on the land or water.

 

(Duty of Report)
Article 76. The pilot-in-command shall, in the event of any of the following accidents. report to the Minister of Transport as may be specified in Ordinances of the Ministry of Transport. When, however, the pilot-in-command is unable to report, the operator of the aircraft shall report.
(1)Fire, crash or collision of aircraft;
